Terms and Conditions

These Terms and Conditions (“Terms”) govern the sale of digital products through this website (the “Store”). By placing an order you accept these Terms. Please read them together with our Privacy Policy, Cookie Policy and Refund and Returns Policy.

1. Seller

The Store is operated by Manuele Montesanti, contactable at info@www.manuelemontesanti.com.

2. Products

All products are digital products delivered electronically by download (for example sound libraries, patches and plug-in content for musical instruments). No physical goods are shipped. Product descriptions state the compatible hardware/software (e.g. Yamaha Montage M / Montage E.S.P Plug-In); it is your responsibility to check compatibility before purchasing.

3. Prices

Prices are shown in Euro (€) on each product page and are those in force at the time the order is placed. Applicable taxes (VAT) are calculated and shown in accordance with the Store’s tax settings and the rules applicable to digital sales in the customer’s country.

4. Orders and contract formation

An order becomes a binding contract when you complete checkout and receive our order confirmation by email. We reserve the right to refuse or cancel an order in case of a pricing error, suspected fraud, or payment that cannot be verified.

5. Payment

Payments are processed securely by third-party providers (Stripe and PayPal). We do not store your full card details. Your payment is subject to the terms and privacy policies of the chosen provider.

6. Delivery of digital products

After successful payment, the download is made available through your account and/or a download link sent by email. Please keep your download safe; you may re-download it from your account where available.

7. Right of withdrawal and refunds

Because our products are digital content supplied by download, the statutory 14-day right of withdrawal is lost once the download has begun, provided you have given prior express consent and acknowledged losing that right at checkout. Full details, and the cases in which we do issue a refund (faulty or non-conforming products, failed downloads, incorrect charges), are set out in our Refund and Returns Policy, which forms part of these Terms.

8. Licence and intellectual property

All products, including sounds, samples, presets, graphics and documentation, remain the intellectual property of Manuele Montesanti (or the respective right holders). On purchase you receive a non-exclusive, non-transferable licence for personal use. You may not resell, redistribute, share, sublicense or make the products available to third parties. Use of the products in your own musical productions is permitted; redistribution of the raw content is not.

9. Liability

The products are provided “as is”. To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from the use of, or inability to use, the products. Nothing in these Terms limits your mandatory statutory rights as a consumer, including the legal guarantee of conformity.

10. Governing law and dispute resolution

These Terms are governed by Italian law, without prejudice to the mandatory consumer-protection rules of your country of residence. If you are an EU consumer and we cannot resolve a dispute directly, you may use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

11. Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your order applies to that order. The “last updated” date above shows the latest revision.
