Overview
All products sold on this website (the “Store”, operated by Manuele Montesanti, reachable at info@www.manuelemontesanti.com) are digital products delivered electronically by download — for example sound libraries, patches and plug-in content. No physical goods are shipped. This policy explains your rights regarding refunds and returns and applies together with our Terms and Conditions.
Right of withdrawal and its exception for digital content
If you are a consumer resident in the European Union, you normally have the right to withdraw from an online purchase within 14 days, without giving any reason (Consumer Rights Directive 2011/83/EU; in Italy, Legislative Decree no. 206/2005 — “Codice del Consumo”).
However, for digital content not supplied on a tangible medium (such as downloadable files), this 14-day right of withdrawal is lost once the download or the supply of the content has begun, provided that you have:
- given your prior express consent to begin the download before the end of the withdrawal period; and
- acknowledged that you thereby lose your right of withdrawal.
You provide this consent and acknowledgment at checkout when you place the order and gain immediate access to the download. As a result, completed digital purchases are generally non-refundable once the file has been made available for download. Please make sure the product is compatible with your device or instrument before purchasing (see the product descriptions for supported hardware/software, e.g. Yamaha Montage M / Montage E.S.P).
When we do issue a refund
Notwithstanding the above, we will provide a refund, replacement or a working download link in the following cases:
- the download does not work or the file is corrupted, and we are unable to provide a working file;
- the product is faulty, defective or materially not as described on the product page;
- you were charged incorrectly or charged more than once for the same product.
These cases reflect your statutory legal guarantee of conformity for digital content (in Italy, Legislative Decree no. 170/2021, implementing EU Directive 2019/770), which cannot be excluded by this policy.
What is not covered
- Change of mind, accidental purchase, or “I no longer need it” after the file has been downloaded or made available.
- Incompatibility due to hardware, software or firmware that does not meet the requirements stated on the product page.
- Lack of technical knowledge to install or use the product (we are happy to help — see below).
How to request a refund
Email info@www.manuelemontesanti.com with your order number, the product name and a description of the problem (including screenshots or error messages, if any). We will review your request and reply as soon as possible.
If a refund is approved, it will be issued to your original payment method (the card or account used at checkout, via Stripe or PayPal) within 14 days of our confirmation. Depending on your bank or payment provider, it may take a few additional business days for the amount to appear on your statement.
Licence note
Digital products are licensed to you for personal use and may not be resold, redistributed or shared. A refund, where granted, terminates your licence and requires you to delete all copies of the product.
Dispute resolution
This policy is governed by Italian law. If you are an EU consumer and we cannot resolve a complaint directly, you may use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. This does not affect your statutory rights.
